If it is urgent, say so and send it

If the content shows a child, or shows you, in an intimate image you did not agree to have published, do not wait to get the form perfect. Send what you can and we will act on it. Content of that kind is removed on notice — we do not ask you to prove you own the copyright first, and we do not put it to the person who posted it for comment before taking it down.

Publishing an intimate image of someone without their consent is an offence under section 16 of the Cybercrimes Act 19 of 2020 and section 18F of the Films and Publications Act. Child sexual abuse material is reported to the South African Police Service and the Film and Publication Board in every case. In an emergency, call the SAPS on 10111.

What this form is

Section 77 of the ECT Act lets anyone notify a service provider of unlawful content it is hosting. A notice that contains everything section 77(1) lists obliges us to act. The form below collects exactly those items, in that order, so what you send is a valid notice rather than an email we have to come back to you about.

What happens next

You get an acknowledgement with a reference number as soon as the notice is lodged.
We assess it. Content that is unlawful on its face — child sexual abuse material, non-consensual intimate images — is disabled immediately, before any further correspondence.
For everything else we assess within 2 business days and tell you the outcome.
If we take content down we tell the person who posted it what was removed and why, so they can dispute it. We do not pass on your contact details unless a court orders it.

A false notice has consequences

Section 77(2) of the ECT Act makes a person who lodges a notice containing a material misrepresentation liable for damages for any resulting loss. Lodge a notice because content is unlawful, not because you dislike it or dislike the person who posted it.
